A new chapter of justice: The Supreme Court said, the general seat will be considered to bring more number than the reservation quota

News India Live, Digital Desk: A New Chapter of Justice: The Supreme Court has given a very important verdict for millions of youth preparing for government jobs, which has changed an important provision in the 64 -year -old reservation rules. This decision has been given by a bench headed by Chief Justice of India (CJI) DY Chandrachud. This is not just a legal change, but a major step towards the balance of social justice and merit.

What was the 64 -year -old rule?
Imagine, if you come from OBC (Other Backward Classes), SC (SC) or ST (ST (Scheduled Tribes)) and you have achieved such good numbers in the exam that you have also crossed the cut-off of general category (general category). The rules that have been going on since 1960 used to say that even in such a situation you will be counted on your own reserved category (eg OBC) seat and not on the general class seat.

What did this mean? This meant that even if an OBC candidate could get a general seat on the basis of his merit, he would still take a seat in his reserved category. With this, no other candidate of that reserved category could get a chance, which may have been more needed for that reservation, while the general class seats were filled with candidates whose numbers were less. It was a kind of discrepancy.

What has changed now? Supreme Court’s new decision:
The Supreme Court has overturned this 64 -year -old rule. According to the new decision:

  • Eligibility for Honor: Now if a candidate of reserved class (OBC, SC, ST) achieve so much merit on the strength of his hard work and merit that he also crosses the cut-off of the general class, then it General class seat But it will be counted only.

  • Correct advantage of reservation: In such a situation, the seat of the reserved class, which would have been taken by the first merit candidate, would now be vacant. This vacant seat will be given to any other candidate of that reserved category, who may not have got that much merit but he comes under the purview of reservation and he really needs that seat.

Why was this rule changed?
This decision of the Supreme Court is to ensure that the benefits of reservation reach those who need the most. It establishes a better balance between merit and social justice. The purpose of this is that the meritorious reserved candidates capture the general seats on the basis of their qualifications, so that the reserved category seats should be available to those who are slightly behind the merit but are entitled to the opportunity through reservation. This in a way makes the recruitment process more fair and effective.

What does it mean?
This decision will affect the entire process of staff recruitment in government jobs. This will ensure that qualified candidates get the right place according to their capacity, and the purpose of reservation is also fulfilled. This is a good news for millions of youth who work hard and want to move forward on the strength of their ability, whether they come from any category.
